1. General Provisions
- Yummo is an AI-powered meal planning application designed for individuals and households.
- The service is owned and operated by Wiktor Strzelczyk, a sole proprietor registered at ul. Stanisławowska 47, 54-611 Wrocław, Poland, CEIDG, Tax ID (NIP): 7692137634, REGON: 385207659 (hereinafter "Yummo", "we", "us").
- By using the service, you agree to these Terms of Service. If you disagree with any provision, please discontinue use of the service.
- These Terms apply together with our Privacy Policy and Cookie Policy, which form an integral part of this agreement.
2. Eligibility
- Yummo is intended for users who are at least 18 years old.
- By registering, you confirm that you are at least 18 years of age.
- If you use Yummo on behalf of a household, you confirm that you have the right to manage data for the people whose profiles you create (e.g. partner, children over 18).
- You are responsible for maintaining the confidentiality of your account and password.
3. Nature of Service — Health Disclaimer
- Yummo is NOT a medical, dietary, or therapeutic application within the meaning of medical device regulations.
- Recipes and meal plans generated by Yummo are CULINARY SUGGESTIONS — they do not constitute medical, dietary, or therapeutic advice.
- Nutritional values (calories, macronutrients) are estimates based on USDA database data. Actual values may vary depending on manufacturer, preparation method, and portion size.
- Before starting any diet, especially if you have health conditions (diabetes, heart disease, eating disorders), we recommend consulting a doctor or registered dietitian.
- Yummo does not replace professional medical or dietary care.
4. Allergies and Food Safety
- Yummo offers allergen filtering based on your profile declarations. However, the filtering algorithm DOES NOT GUARANTEE 100% effectiveness.
- Processed food products (sauces, spices, preserves) may contain trace amounts of allergens, even if the main ingredient is not listed as an allergen.
- AI-generated recipes may contain errors in ingredient selection.
- Your obligation: ALWAYS verify product labels before purchase and consumption.
- People with severe food allergies (anaphylaxis) should consult an allergist before making any dietary changes.
- Yummo is not liable for allergic reactions resulting from use of the application.
5. AI and Automated Processing
- Yummo uses artificial intelligence (AI) to generate recipes and personalize meal plans.
- AI-generated content consists of suggestions — we do not guarantee their accuracy, completeness, or suitability for your individual needs.
- AI does not account for all possible interactions between ingredients, medications, or individual bodily reactions.
- We continuously improve our algorithms but do not guarantee they are error-free.
- You accept the limitations of AI technology and understand that generated content may require verification.

6. User Obligations
- Accurately and truthfully declare allergies and food intolerances in your profile and household member profiles.
- Verify product labels before purchase and use.
- In case of health problems, consult a doctor rather than relying solely on application information.
- Use the application according to its intended purpose — meal planning.
- Do not attempt to circumvent technical safeguards or use the application in a way that could disrupt its operation.
- Do not use Yummo to generate content that violates the law, third-party rights, or good practices.
7. Subscription and Payments
Plans and pricing:
- Yummo offers a free plan (with limitations) and premium plans (paid).
- Current prices and the scope of each plan are visible on the pricing page before purchase.
- Prices are shown including VAT (for EU users).
Automatic renewal:
- Premium subscriptions renew automatically at the end of each billing period (monthly or annual).
- We will send a reminder email before renewal.
- You can cancel your subscription at any time in your account settings. Cancellation is as simple as purchase.
- After cancellation, you retain access to premium features until the end of your paid period.
Right of withdrawal (EU/UK users):
- Under the Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal from digital purchases.
- If you begin using the premium service within 14 days and have consented to this, the right of withdrawal expires.

Refunds:
- Outside the right of withdrawal (EU/UK), we do not offer refunds for partially used subscription periods.
- In case of significant technical issues preventing use of the service, contact us — we will review each case individually.
8. Intellectual Property
Our property:
- The Yummo application, its source code, design, logo, algorithms, and ingredient database are the property of Wiktor Strzelczyk.
- System recipes (built into Yummo) are protected by copyright.
Your property:
- Recipes you create remain your property.
- You grant us a limited license to process your content solely for the purpose of providing the service (generating plans, calculating nutritional values, etc.).
- We do not use your recipes to train AI or share them with other users without your consent.
9. Limitation of Liability
General:
- Yummo is provided "as is". We do not guarantee uninterrupted, error-free operation of the service.
- We are not liable for health damage resulting from non-compliance with medical recommendations or relying solely on application guidance.
- Our liability is limited to the amount you paid for the service in the preceding 12 months.
For EU/UK users:
- The above limitations do not affect your statutory consumer rights under EU and UK law.
- We do not limit liability for damage caused by our willful misconduct or gross negligence.
- You are entitled to a remedy, replacement, or refund for defective digital content under the Digital Content Directive (2019/770).
For Australian users:
- Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
- The limitations of liability in these Terms are subject to your rights under the Consumer Guarantees.
10. Account Suspension and Termination
- You can close your account at any time in your account settings or by contacting us.
- We reserve the right to suspend or close your account if you violate these Terms, abuse the service, or engage in activity that threatens the security of other users.
- Before closing your account (at our initiative), we will inform you by email and allow you to download your data.
- After account closure, your data will be deleted in accordance with the Privacy Policy (30 days for data, 90 days for backups).
11. Personal Data
- We process personal data, including health data (allergies, biometric data, nutrition goals).
- For detailed information about what data we collect, who we share it with, and your rights, see our Privacy Policy.
- By using Yummo and creating a profile with health data, you provide explicit consent for processing this data to personalize the service. You can withdraw consent at any time.
12. Governing Law and Dispute Resolution
Governing law:
- These Terms are governed by Polish law, subject to mandatory consumer protection provisions in your country of residence.
For EU users:
- If you are a consumer in the EU, you benefit from the mandatory provisions of consumer protection law in your country of residence.
- You may file a complaint through the European Commission's ODR platform: ec.europa.eu/consumers/odr

For users outside the EU:
- Disputes will be resolved by the court having jurisdiction over Wiktor Strzelczyk's registered office (Wrocław, Poland), unless the laws of your country of residence provide otherwise.
13. Changes to Terms
- We may update these Terms as the service evolves or laws change.
- We will notify you of significant changes by email or in-app notification at least 14 days in advance.
- Continued use of the service after changes take effect constitutes acceptance of those changes.
- If you disagree with changes, you can close your account before they take effect.
